A. Terms, Conditions, and Policies Applicable to All Poker Tournaments

1. General

In tournament poker, the players will receive tournament chips that have no cash value and which cannot be removed from play or used in other poker games. In the poker tournament lobby, players will have access to information regarding the blind structure for the tournament, the number of players who may play in the tournament, and the payout structure for the tournament. The tournament concludes when one (1) player has accumulated all of the chips. A player is eliminated from the tournament (“knocked out of the tournament”) when they lose all their chips. In the event multiple players are knocked out of the tournament in the same hand, for purposes of determining finishing positions in the tournament and attributing any prizes, the aggregate value of chips held by such players at the start of the hand they were knocked out in will be used as a tiebreaker, with the player(s) with the smallest aggregate value of chips being deemed to have been eliminated before the player(s) with a higher aggregate value of chips. In the event multiple players are knocked out of the tournament in the same hand and started the hand with the same chip count, any prizes associated with such finishing position(s) will be distributed evenly amongst such player(s). For example, in a three-person tournament where second (2nd) place in the tournament pays out one hundred dollars ($100) and third (3rd) place pays out fifty dollars ($50), in the event the two (2) players who did not finish in first (1st) place are knocked out of the tournament in the same hand and started the hand with the same aggregate value of chips, each of the knocked out players would receive seventy-five dollars ($75).

We may amend these Poker Tournament Policies and/or any other poker tournament rules at any time without notice. Any amendments to these Poker Tournament Policies and/or any other poker tournament rules will take effect once they are posted to the DraftKings website or mobile application. It is your responsibility to review these Poker Tournament Policies and any other applicable poker tournament rules prior to entering a tournament. By entering or continuing to participate in the poker tournament after we amend these Poker Tournament Policies or any other applicable poker tournament rules, you agree to such amendments.

2. Tournament Cancellation

We reserve the right to cancel any tournament at any time, including tournaments that have or have not commenced, for any reason, or no reason, in our sole discretion, including, but not limited to, in the event of server failures, connection issues, network issues, or failure to attract the required minimum number of players.

In the event a tournament has not yet commenced (a tournament commences upon the first card being dealt), and the tournament is canceled, all registered players will be refunded their buy-in. In the event a tournament is canceled after the tournament has commenced: (i) players will not be refunded their tournament buy-in or any other costs attributed to the canceled tournament; (ii) player(s) who have been knocked out of the tournament prior to cancellation will receive any prizes associated with their finishing position in the tournament; and (iii) fifty percent (50%) of the canceled tournament’s prize pool minus any amounts already paid to winning positions (“Unattributed Prize Pool”) will be distributed equally between the remaining players in the tournament at the point of cancellation, and the other fifty percent (50%) of the Unattributed Prize Pool will be distributed on a percentage basis according to each player's chips (i.e., the aggregate value of the chips held by a player divided by the aggregate value of chips in the tournament) at the start of the hand when the tournament was canceled. As an example only, in the event a tournament is canceled with only two (2) players left, and the tournament prize is to be awarded to 1st place only, one player had sixty-five percent (65%) of the aggregate value of tournament chips at the start of the hand when the tournament was canceled, and the Unattributed Prize Pool was two thousand dollars ($2,000), the player with sixty-five percent (65%) of the aggregate value of tournament chips would receive one thousand one hundred fifty dollars ($1,150).

3. Tournament Disconnect

In the event a player is disconnected from the tournament and unable to rejoin and take their next action within the allotted time given to the player to take their next action in the tournament via the tournament’s action timer and/or time bank, such player will be set to auto fold for every required action of the player (“Sat Out”), and gameplay will continue for other active players. A disconnected player will be Sat Out until they rejoin the game and take an action during their next turn. Players will be able to rejoin the game via the “My tables” tab, located in the lobby, and return to action in the event the tournament is still in progress and they have chips remaining. In the event a player does not rejoin a tournament they were disconnected from, that player will be Sat Out until they are either knocked out of the tournament or the tournament concludes. Players who remain in a Sat Out state and are then either knocked out of the tournament or win the tournament while in a Sat Out state are eligible for any prizes based on their finishing position in the tournament.

A player’s time bank in a tournament is associated only with that individual tournament. A player will receive a new and separate time bank for each new tournament the player enters.

B. Terms, Conditions, and Policies Applicable to Specific Types of Poker Tournaments

Electric Poker Tournaments

In addition to the terms, conditions, and policies set forth in Section A (Terms, Conditions, and Policies Applicable to All Poker Tournaments) above, the following terms, conditions, and policies shall also apply to Electric Poker tournaments. For detailed rules for Electric Poker tournaments please refer to the Electric Poker Game Rules.

Registration

  • An Electric Poker tournament may commence as soon as the required number of players have all been registered for that Electric Poker tournament.
  • Players will be allowed to unregister from an Electric Poker tournament as long as all the seats in the Electric Poker tournament have not been filled.

Electric Poker Tournaments

  • The Prize Pool Multipliers for an Electric Poker tournament are randomly drawn from the following possibilities: 2x, 3x, 4x, 5x, 10x, 100x, 1,000x, and 10,000x. Prizes associated with each prize pool multiplier will be distributed based on the following table:

  • All players in Electric Poker tournaments will have their blinds and/or antes automatically posted.
  • In Electric Poker tournaments, player seating and assignment of the small blind, big blind, and dealer button are randomly assigned before the start of the first hand.
  • Players who do not act on their hand in time (including the player’s time bank allowance) will be Sat Out, and blinds and antes will be automatically posted.
  • In the event a player is Sat Out and has not been knocked out of the Electric Poker tournament, that player may rejoin play by clicking the “REJOIN PLAY” button on the table at any time during the Electric Poker tournament. In the event a player rejoins an Electric Poker tournament, the player’s action timer will recommence; however, the player’s time bank will not be replenished.
  • Each player in an Electric Poker tournament will post an ante, followed by the respective players placing a small blind and a big blind every round.
  • In Electric Poker tournaments, the dealer button moves to the next player, clockwise, at the start of every new hand. When a player has the dealer button, they are referred to as “the dealer.” When three (3) players are in an Electric Poker tournament, the dealer button indicates that the person sitting to the left of the player with the dealer button will post the small blind.
  • When a player is eliminated from an Electric Poker tournament and only two (2) players remain (“Heads Up”), the dealer button will move forward to the next available player. When Heads Up, the player on the dealer button will post the small blind and act first before the flop.

Payout

Player(s) receive prize(s) upon elimination from the Electric Poker tournament in the event they are in a prize winning position or when they win the Electric Poker tournament.

Electric Poker Cancellation Policy

In the event an Electric Poker tournament is canceled prior to the first card being dealt, all players will be refunded their buy-in, regardless of the spinner selecting a prize or not. In the event the Electric Poker tournament has commenced and is then canceled, the Tournament Cancellation Policy set forth in Section A(2) (Tournament Cancelation) applies.
